NO FCRA USE. This is a privately run website with no government affiliation. It and its advertising partners do not provide a service for credit, employment, insurance, tenant, or other decisions governed by the Fair Credit Reporting Act. Gilmer County Criminal History is not a consumer reporting agency or private investigation firm.
1. What This Website Is
Gilmer County Criminal History is an independent reference resource. It does not hold official files, produce government background checks, retrieve records, or submit paperwork for users.
Its role is to identify official sources such as the Gilmer County Sheriff, magistrate and circuit courts, West Virginia State Police Criminal Identification Bureau, WVDCR, and West Virginia Sex Offender Registry. Outside search tools may also be linked as separate services.
2. Rules for Using This Site
By using the website, a visitor agrees not to:
- violate federal, West Virginia, or local law
- stalk, threaten, intimidate, or harass another person
- use information for any decision regulated by the FCRA
- seek unauthorized access to systems or data
- deploy bots, scrapers, or automated collection tools
- interfere with performance or another visitor's access
3. No Harassment, Stalking, or Discrimination
Information reached through this website may not be used to stalk, threaten, harass, intimidate, or unlawfully discriminate against anyone. Registry data deserves special care. W. Va. Code ยง15-12-5 controls public distribution, and WVSP warns that threats, intimidation, and harassment involving registry information will be investigated. The registry exists for lawful public-safety precautions, not retaliation or vigilante acts.
4. We Are Not a Consumer Reporting Agency
This website does not create consumer reports, credit reports, or official background checks and is not a consumer reporting agency under the FCRA. Visitors must not use its content or a linked search result for:
- employment or workforce decisions
- housing or tenant screening
- credit or insurance eligibility
- license, permit, or government-benefit eligibility
- any other FCRA-regulated purpose
A legally required official check must be obtained through the authorized West Virginia State Police and fingerprint process or another provider that is legally permitted for the specific purpose.
5. No Legal Advice
Content is general information, not legal advice. It cannot determine how a Gilmer County charge, warrant, conviction, sentence, or expungement law affects an individual. Advice on a particular matter must come from a licensed West Virginia attorney.
6. No Warranties
The website and its content are supplied on an "as is" and "as available" basis. No warranty is made that:
- information is always accurate, complete, or current
- service will be continuous or error free
- pages will be free of bugs or security defects
- an outside provider's search will be complete or correctly matched
Charges, dispositions, custody status, access rules, hours, and fees can change. A court, sheriff, WVSP, or WVDCR source remains the authority for its own record.
7. Third-Party Services and Links
Links lead to government portals, statutes, agency pages, and outside search services that we do not control. The destination sets its own price, terms, privacy policy, content, and availability. Users should review those terms before submitting data or payment.
8. Intellectual Property
Text, graphics, logos, and code on this website belong to Gilmer County Criminal History or the relevant content partner. They may not be copied, altered, distributed, or used to create another work without prior written permission, except where law permits.
9. Limits on Our Liability
To the fullest extent allowed by law, we are not responsible for direct, indirect, incidental, consequential, or other damage arising from use of this website, reliance on its content, or use of a linked service.
10. Indemnification
A visitor agrees to defend and hold us harmless from claims, demands, costs, and legal fees caused by that visitor's unlawful use, violation of these conditions, or infringement of another party's rights.
11. Governing Law
West Virginia law governs these terms without regard to conflict-of-law rules. Any lawsuit tied to use of the website must be brought in a court with proper jurisdiction in West Virginia. Requests for government records are independently governed by the West Virginia Freedom of Information Act and other laws applicable to the public custodian.
12. Changes to These Terms
We may revise these terms. A revision takes effect when the updated language is posted on this page.
13. Cutting Off Access
We may suspend, restrict, or end a visitor's access at any time and without prior notice.
14. Severability
If a court finds one provision invalid or unenforceable, the remaining provisions continue in effect. The affected provision will be limited only as much as required to make it enforceable.
15. Questions
Questions about these conditions may be directed through the Contact page.
